1. GENERAL

Validity of the General Terms and Conditions, conclusion of contract, time of payment

All course participants who enter into a contract with sprachart BERLIN GbR, Großbeerenstr.82a, 10963 Berlin, are bound by the following terms and conditions. The contract is considered concluded as soon as the booking form is filled in and sent. The course fee must be paid immediately, but no later than 3 days after receipt of the course reservation, into the school’s bank account or in cash at the school office.

Course booking

In order to book a course and conclude a contract, the registration form must be filled in online or the registration must be made in the school’s office. The course booking obliges the student to pay the course fee and the registration fee. The registration fee is charged in addition to the course price and amounts to 10€. It remains valid for 2 months after the end of a course at our school.

 

Rebooking and Cancellation

a) A change of course or course time is generally possible if there is sufficient capacity in the desired course, provided that it is the same course format (e.g. intensive course to intensive course) and the desired course takes place in the same month for which the fees have been paid. The desired change should be communicated to the office in advance. Any price difference must be compensated. The first change of booking is free of charge, all further changes cost 10€. However, please note a change of course is not always possible.

b) Cancellations or changes for an agreed individual lesson must be communicated to the school office at least 24 hours before the scheduled time during office opening hours. Only then can the fees be refunded or used to book a new appointment. If agreed lessons are cancelled late or not attended, they must be paid for.

c) Cancellations or changes for an agreed company course must be notified to the school office at least 7 days before the scheduled date during office opening hours. Only then can the fees be refunded or used to book a new date. If the agreed course is cancelled late or not attended, the full course fee must be paid.

d) The course participant is entitled to cancel booked courses up to 7 days before the start of the course without giving any reason by simply giving written notice.

If the language course is cancelled up to 30 days before the start of the course at the latest, the course fees will be refunded minus a cancellation fee of 10% of the agreed course fee. If the cancellation is made more than 20 days before the start of the course, the school will charge a cancellation fee of 20% of the agreed course fee. If the course is cancelled up to 7 days before the start of the course at the latest, the cancellation fee is 50% of the course fee. If the 7-day deadline is exceeded and after the start of the course, no payments will be refunded. Separate cancellation conditions apply for a visa course (see subsection f).

e) The registration fee is not refundable

f) Visa and residence permit

If a course candidate requires an entry visa for Germany and a registration for the German course to be submitted to the German embassy for a visa application, this will be issued after conclusion of the contract and receipt of the course fee plus the processing fee of 50€. This fee includes the preparation of the contract, issuing and sending by e-mail as well as the registration fee. Only after receving the payment will sprachart BERLIN send the course contract by e-mail. Course participants can have the documents for the issuing of the visa sent by an express service if they wish (additional costs apply). The course participants must ensure themselves and at their own expense that their stay in Germany is legal and that they have the necessary entry or residence permit/visa. In case of rejection, we will refund the prepaid course fee minus the non-refundable registration fee of 50€ (see above) and a cancellation fee of 80€ (total 130€). The refund can only be made if a written rejection of the application from the respective embassy is presented in the original in German or with an officially certified translation at the latest one month after issue to the office of sprachart BERLIN. If this does not happen, the obligation to pay remains valid and no refund of the course fee will be made. Cancellation of the course must be made in writing (e.g. by e-mail) at least 7 days before the start of the course. If the cancellation is made later than 7 days before the start of the course, the course fees will not be refunded. Lessons which cannot be attended by the course participant after the course start due to illness or other reasons, or which can only be attended after a delay, are cancelled without substitution. There is no entitlement to a refund. In case of course cancellation within permitted cancellation period, all documents issued by the school must be returned to the school office. If the course participant receives a visa with the documents from sprachart BERLIN, there will be no cancellation or refund of the fees paid and the obligation to pay will remain in force for the entire duration of the contract. The start and duration of the contract are stipulated in the contract. A change of the course start date is possible for a fee of 25€, as long as we are informed at least 7 days before the course start date stipulated in the contract. A change of course start date is restricted to 3 times. The visa course contract expires automatically after 30 months.

Right of withdrawal

There is no entitlement to a 14-day right of withdrawal, as all our services are capacity-limited and take place within a predetermined period of time. We refer to the judgment of the Regional Court of Bielefeld from June 5, 2012, Ref.: 15 O 49/12, according to which a revocation would be unreasonable for the provider.

g) telc examinations

A postponement of the examination date is possible free of charge up to one day before the regular registration deadline. A cancellation of the exam registration is also possible up to one day before the regular registration deadline upon a cancellation fee of 25€. After this deadline, the examination date can not be changed and the fee will not be refunded. In case of illness on the day of the examination, the candidate should submit a medical certificate to the examination centre within one week of the examination date. If accepted by telc gGmbH, the examination fee can be refunded after deduction of a cancellation fee of 65€.

Validity of the contract

Registration for a language course requires written confirmation from sprachart BERLIN in order to be valid. The start and duration of the contract are stipulated in the contract. Lessons which cannot be attended by the course participant due to illness or other reasons, or which can only be attended after a delay, are cancelled without substitution. There is no entitlement to a refund. The contract extends not automatically and is valid only for the paid period. In case of payment in installments, the payment obligation will remain in force for the entire sum and the duration of the contract. For visa courses apply also conditions in f) Visa and residence permit (see above).

Data protection

sprachart BERLIN is allowed to process and store the data concerning the respective contract as far as this is necessary for the execution and handling of the contract and as long as sprachart BERLIN is obliged to store this data due to legal regulations. The contractual data shall be electronically stored and used by sprachart BERLIN exclusively for the purpose of contract execution, including billing. The parties agree to treat personal, company and contract-related data of the contractual partner confidentially and to make information accessible to third parties only insofar as this is necessary for the fulfilment of the purpose of the contract or legal obligations. The collection, transmission or other processing of personal, company and contract-related data of the participant for purposes other than those mentioned above is not permitted.

Internet Use W-LAN HotSpot of sprachart BERLIN

The data traffic between the school’s hotspot and the participant’s end device is transmitted unencrypted. It is therefore possible that third parties can view and/or access the transmitted data. The course participant is responsible for the protection (e.g. through a suitable firewall, virus protection, regular data backup, etc.) and encryption (e.g. https, VPN) of their data. The hotspot operator (sprachart BERLIN) acts as a neutral technical intermediary and has no influence on the mediated content. The user himself is responsible for internet contents. The user undertakes not to misuse the hotspot. In the event of fault, the hotspot user shall be liable to us, i.e. the hotspot operator, for compensation for any damage incurred. The law of the Federal Republic of Germany shall apply.

 

2. GERMAN LESSONS

a) Lesson plans

The lesson plans are determined by the school management.

b) Duration

One lesson lasts 45 minutes.

c) Attendance & participation

Each student is required to attend and participate in class on a regular basis.

d) Minimum number of participants

The minimum number of participants for a course is 6. If the minimum number of participants is not reached, the school management is entitled to postpone the course to another date, to integrate the affected group or individual participants into other courses, to change the time of the course, to shorten the course or to propose an alternative course. If the cancellation or postponement of the course is necessary due to organisational circumstances, the entire course fees will be refunded. There is no right to compensation.

We reserve the right to postpone telc examinations for which fewer than 4 participants have registered to another date.

e) Cancellation

In spite of careful planning, we can only promise dates subject to the availability of the teacher in question. For lessons cancelled due to illness or similar, a make-up date will be arranged or a replacement provided. Only if this is not possible for organisational reasons on our part will the participant be entitled to a refund of the lesson fees for the cancelled lessons. Should it be temporarily impossible to hold the lessons on our premises due to an emergency not caused by us (burst pipe, external force e.g. flooding, pandemic) and no alternative is offered by us (e.g. holding the lessons at another location or online lessons), the participant is entitled to a refund for the cancelled lessons. Further claims, including claims for damages, on whatever legal grounds, are excluded in any case.

f) Absences

Course participants who are absent for more than 80% of the course time are not entitled to a certificate of attendance. Under certain circumstances, a new placement test will be carried out for the booking of a follow-up course.

 

3. PAYMENT

a) Due date

The agreed course fees are due immediately and must be paid no later than 3 days after the booking has been made. A reminder fee of 5,50€ will be charged for late payment.

b) Default

If the participant is more than 3 days in arrears with the due course fee and has not paid the fee after a reminder from sprachart BERLIN, we reserve the right to instruct third parties (e.g. a collection agency), which will incur additional costs.

c) Refund & expiry

A refund of the course fee before the start of the course is generally possible after deduction of a cancellation fee (see point 1 Rebooking and Cancellation). Course fees paid after the start of the course are non-refundable. In the event of non-participation in the German course or discontinuation by the course participant during an ongoing course due to illness or other reasons, the fees paid are forfeited without compensation. There is no right to compensation.

d) Payment costs

Payments have to be carried out in Euro (€). All transfer fees and bank charges, including those for transfers from abroad, shall be borne by the course participant.

e) VAT

According to sec 4, no. 21(a)(bb) of the German Turnover Tax Act (UStG), language courses with the aim of acquiring adequate knowledge of the German language are exempt from value added tax. sprachart BERLIN is obliged by law to collect the statutory VAT of currently 19% on telc exams. For these exams liable to VAT the taxes are already included in the published prices.

 

4. MISCELLANEOUS

a) Correctness /Updating of information

Each course participant assures to provide truthful information about themselves and their language skills when registering for the language course. In the event of a misclassification due to incorrect information in the placement test, no refund of the course fee will be made and the school is not obliged to provide a substitute course. Furthermore, each student is obliged to inform the school management of any change of residence during the course.

b) Public holidays

There are no classes on weekends and national holidays. If a course day falls on a public holiday, there is no right to a refund. The days missed as a result will not be made up.

c) Course books

Course participants purchase the course books themselves.

d) Damages

sprachart BERLIN can exclude participants from lessons who violate the instructions of the school management, the teaching staff or the school administration, or who violate these contractual regulations, after prior warning. In this case, the participant’s obligation to continue to pay the tuition fees for the entire duration of the course expressly remains in effect. Tuition fees already paid will not be refunded.

e) Photos/Advertising

sprachart BERLIN reserves the right to take photos of the classes and course participants during lessons or leisure activities with prior notice and to use them for advertising purposes of the language school.

f) Agreements

All agreements concerning school matters can only be made with the school management. Contractual agreements with the teacher are invalid and can only be made in the school office with the school management or the school office manager. Only written agreements are valid.

 

5. WARRANTY

The statutory warranty law applies.

 

6. LIABILITY

a) sprachart BERLIN is not liable for course participants‘ cloakroom or other items of any kind brought along.

b) Participation in the course and the leisure programme is at the participant’s own risk. sprachart BERLIN is not liable for accidents on the way to and from school or to and from the venue of the cultural programme. The school declines liability for any damage during joint activities outside the school. Course participants are responsible for taking out their own health and private liability insurance.

c) For damages of any kind caused by the course participants themselves, they are directly liable to the injured party.

d) sprachart BERLIN is not liable for cancellation of lessons due to force majeure.

e) sprachart BERLIN is basically only liable for its own fault in cases of intent and gross negligence and for the usual care in the selection of third parties employed for the fulfilment of the contract. If necessary third party services are used which are not part of a sprachart BERLIN service, sprachart BERLIN is not liable for third party services as for a vicarious agent.

 

7. LAW & CONTRACT

The entire legal and contractual relationship between the client and sprachart BERLIN shall be governed exclusively by German law. The contract language is German. The contract text is saved.
